1)    The ITALEGAL law office is neither a partnership nor a company. Each practitioner operates independently and is solely responsible for his or her work, acting on instructions conferred on the individual practitioner, whether formally or informally. Practitioners share only certain management services and there is no joint or joint and several liability between members of the grouping. Any claim must be made exclusively against the individual practitioner or practitioners who have actually carried out the work, up to a maximum of five times the net fee paid for work on the particular matter on which the claim is based. The place of performance of all the obligations of the parties in any way deriving from the giving and/or carrying-out of instructions is exclusively Verona, which is the address for service of all the practitioners; and this applies even if work has been wholly or partly carried out elsewhere.

 

2)    The professional contract between client and practitioner is governed by Italian law in force at the time of starting the professional relationship and the courts having exclusive jurisdiction in any dispute between client and practitioner are those of Verona, save that the practitioner, in cases permitted by law, may choose to take proceedings in the place where the client has its registered office, residence or address for service.

 

3)    These conditions shall override any other general conditions of the other parties and no derogation from them shall be valid unless agreed in writing.

Our law office regularly receives young foreign lawyers (mainly German but also Austrian, Swiss and Brazilian) for work experience.

Specifically, pursuant to agreements with the relevant authorities in Germany, the law office has over the course of thirty years received more than 120 German law graduates (Rechtsreferendare) who have each spent a three- or four-month “stage” working here in the course of their official training.

For young, suitably qualified Italian lawyers, the law office provides opportunities to be received as practitioners within the office and also to travel abroad for work placements, whether in businesses, banks, insurance companies or in the law, tax and notaries’ offices with which we have connections.

Our law office has traditions going back to the second decade of the last century, when Silvio Marzari senior (1886-1967) started in practice as an advocate (avvocato), before becoming a magistrate and reaching the highest level in his career as Public Prosecutor General (Procuratore generale) at the Court of Cassation.

Since then our law office has evolved, concentrating on civil and commercial law, with particular reference to international private law and procedure and EU law. We have many foreign connections, especially with Germany, Austria, Switzerland, the UK, the USA, Brazil and other Latin-American countries and with the Far East. The lawyers in our team have all had part of their training abroad and most of them work fluently not only in Italian but also in English and German. They provide advice and assistance in Italian and trans-national business matters, including company law, mergers and acquisitions, company formation, intellectual property law, contract law (including supply, distribution and franchising, agency and transport contracts), property law, arbitrations, winding-up and other insolvency procedures. Consequently we have acted for many of the largest foreign businesses which are present in this area of Italy; and also for many of the larger Italian companies establishing themselves or indeed conducting litigation abroad. Our areas of foreign business also include advice and assistance on matters of family law, the rights of children, inheritance, motor accidents, accidents at work, and associated litigation.

The other area of business (to which a specific department in the law office is devoted, for which the law office has a significant reputation), is administrative law in all its various contexts (including construction, planning, expropriation for public utilities, contracts for public works and services, both in Italy and at a European level, trade law and the general public law of the economy, national and local civil service contracts, etc.; and litigation before the regional administrative courts and the national constitutional and administrative courts (the Consiglio di Stato and the Corte dei Conti).

The law office has a well-established network of correspondents in Italy and all the major European countries, as well as in the United States, Brazil and the Middle and Far East.
