Insurance arbitrator; a novelty in the relationship with insurance companies.
We all have insurance policies in place, some of which are compulsory by law, while others are the result of our own decision to avail ourselves of insurance, in order to cope with possible damaging events to our persons and belongings.Sometimes, raise your hand if you have never experienced this, insurance companies take a little long or make an unsatisfactory compensation proposal for the policyholder, reimbursing only part of the damage. In such cases, one has to turn to a lawyer, to read the insurance contract and find out whether, how and where one can go to court to obtain justice.
But as of today there is another possibility to resolve these disputes: the Insurance Arbitrator, an out-of-court settlement tool for disputes between customers and insurance companies and insurance intermediaries over insurance contracts as provided for in Article 141.7 of the Consumer Code and Article 187.1 of the Insurance Code. It is an out-of-court settlement body, like those already existing for the banking and financial sectors (ABF) for financial disputes (ACF).
The reference regulation is European Directive No. 11 of 2013, applied in Italy by Ministerial Decree 215 of 6.11.2024 The Insurance Arbitrator is located at the IVASS. Italian companies and intermediaries become members without the need for special notices. The body is composed of panels in Italy consisting of competent individuals with a high level of independence from insurance companies. The procedure for activating it is simple and online, but the submission of the client's appeal to the arbitrator, under penalty of inadmissibility, must be preceded by the submission of a complaint to the insurance company.
Beware that the Insurance Arbitrator does not make decisions that can then be compulsorily enforced. However, the insurance company is bound to the arbitrator's decision within 30 days. Failing this, the insurance company's default is made known to everyone, with publication in a special section of the Insurance Arbitrator's website, for a period of five years.
The policyholder will therefore always be free to take legal action even in the event of a decision that is not satisfactory to its interests. It is to be expected, however, that the insurance arbitrator's decisions will be respected by insurance companies, both as a matter of image and to avoid litigation, and that this will help to have a better relationship with insurance companies.
As an international lawyer, I am often asked for my advice by Italians and Europeans, but also by non-European citizens or people with several nationalities, on where they should pay income tax.Usually, they all try to avoid taxation in Italy, which is known to be rather high, although in reality it does not differ much from the income taxation in the countries closest to us, such as Austria, Germany and France.The same question also applies to companies, but today I will speak instead about the taxation of individuals. There are in fact recent laws, Legislative Decree 209/2023, but above all the Circular of the Italian Tax Agency of 4.11.2024, which have changed the pre-existing regulatory situation. If a person is present in Italy for more than 183 days a year, he/she will be required to pay taxes in Italy.This is one of the main cornerstones, which applies and, this is what is new, regardless of whether or not the person in question is registered with AIRE ( Registry of Italians Resident Abroad).
Much greater emphasis is now placed on the individual's centre of interest, without the economic aspect necessarily being predominant.Of course the reality is much more complicated. Cases are known of people who actually live not in two but in three or even four countries.
In the latter case, careful consideration will have to be given as to the modalities of life to be adopted, in order to avoid finding oneself with very large and perhaps unexpected bills with the Italian tax authorities. If this happens, the essential point, is to have a good legal advisor to handle the matter appropriately.
Dossier, snooping and abusive access to personal data
The chronicles of the last few weeks in Italy have brought to everyone's attention the risk that bank accounts and many other data and information on individuals may be abusively acquired and used for illicit purposes.
We live in an era in which IT and computerisation of all human activities have become pervasive and essential to their performance.However, the legislator is not standing still and as of 16th October 2024, Legislative Decree No. 138/2024, which transposed European Directive 2555 of 2022, came into force in Italy.
This is a regulation alongside the data protection regulation, with which it should not be confused.
This regulation stipulates that companies and entities in many economic sectors, including, but not limited to, banking, transport, energy, food, motor vehicle and transport equipment manufacturing, electronic equipment manufacturing, as well as regional and municipal administrations, must take a whole series of measures to implement so-called ‘cyber security’.
The purpose of the regulation is to prevent unauthorised third parties from unlawfully collecting and acquiring information and data, and on the other hand, to ensure that the continuity of operations of all these entities is guaranteed.
What must companies and organisations actually do?
adopt risk management and IT security and technical and organisational measures;
register on the digital platform, made available to the authorities from 1st January to 28th February each year;
notify the authorities of any technical failures within 24 hours.
Further implementation rules will follow by early next year.
And now the question: is the company or public body where you work getting ready to it ?
adottare misure di gestione dei rischi e di sicurezza informatica e misure tecniche e organizzative;
registrarsi sulla piattaforma digitale messa a disposizione delle autorità dal 1° gennaio al 28 febbraio di ogni anno;
notificare entro 24 ore alle autorità prepostegli eventuali incidenti informatici.
Entro i primi mesi dell’anno prossimo seguiranno altre norme applicative.
As a lawyer I often deal with commercial activities, almost all of which now belong to large multinational groups and are located in shopping centres. As a client I happen, like most people, to shop in shopping centres. Both when I work on tenancy or business leases, and when I go there as a customer, it must be professional strain, I pay particular attention to the risks of accidents, injuries or falls by customers, intent on and perhaps distracted by shopping.
This theme was taken up by a recent interesting judgement: in a shopping centre, just outside the tills there was a bumpy area, signposted to customers of the centre, but not completely delimited and separated from the other areas of normal access for customers. A customer tripped and fell with significant leg injuries. Article 2051 of the Civil Code applies, which speaks of the liability of the ‘custodian’ of the area, i.e. either the person who is carrying out the work or the owner.
Generally speaking, if the area of the works is clearly identified and completely delimited, custody is the responsibility of the person doing the work; if, on the other hand, the area in question remains open to passage, the owner is the custodian, albeit together with the contractor.
Moreover, the fortuitous event, characterised by its unpredictability, releases the custodian from liability. It is also excluded by the conduct of the injured party. In essence, one must examine whether the conduct of the injured party alone was sufficient to cause the accident.
In the present case, the customer of the shopping centre should have been conscious of the danger, as it was clearly perceptible and visible. According to the court, therefore, her fall and the damage were caused by the customer herself, since she did not take the necessary caution and prudence, to allow her to become aware of the obvious state of the place.
When you go to the shopping centre, beware therefore, not only of discounts and promotions, but also of the maintenance work that often necessarily takes place.
